Pakistan grants consular access to Indian spy Jadhav

ISLAMABAD (92 News) – Pakistan formally granted the consular access to the Indian spy Kulbhushan Jadhav on Monday. According to the details garnered, Indian Deputy High Commissioner Gaurav Ahluwalia met RAW agent at a sub-jail in Islamabad. The meeting lasted for two hour. The Foreign Office’s officials were also present during the meeting. It is pertinent to mention here that Jadhav – who was arrested from Balochistan by security agencies over espionage charges – was convicted and sentenced to death by a military tribunal for spying. According to the sources, India has officially replied to the Pakistani offer for granting consular access to Kulbushan Jadhav. Indian media confirmed that Deputy High Commissioner Gaurav Ahluwalia will meet Indian spy today and Pakistani officials will also present during the meeting. Meanwhile, New Delhi wants unimpeded and unrestricted access to the convicted spy. Indian spy Kulbhushan Jadhav will be allowed to have access to the consular today (Monday), Pakistan’s government announced. In a statement, Foreign Office spokesperson Dr Mohammad Faisal said that the access is being provided in line with Vienna Convention on Consular relations, International Court of Justice’s judgement and the laws of Pakistan. He is being granted consular excess after the International Court of Justice’s (ICJ) verdict had asked Pakistan to immediately inform Jadhav of his rights under Article 36 and grant him India consular access. Pakistan has formally informed the Indian High Commission and is awaiting response.

The ICJ, in its ruling, had asked Pakistan to ensure effective review and reconsideration of his conviction and sentences. The ICJ ruled even though it had found Pakistan in violation of Article 36 the Vienna Convention on Consular Relations (VCCR), “it is not the conviction and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention.” The most the ICJ said it could do was to order Pakistan to cease violation of Article 36 and review the case in light of how that violation may have affected the case’s outcome. At the end, Pakistan was directed to immediately inform Jadhav of his rights under Article 36, grant India consular access, and then review the case while considering existing laws of the country. Earlier, showing usual stubbornness, India lost opportunity to get consular access to Kulbhushan Jadhav, an Indian spy, as it raised questions over Pakistan’s offer and imposed self-created conditions. Pakistan had earlier made it clear that the meeting would be held on Friday at 3pm but India sent its response to Pakistan two hours prior the meeting. In response to Pakistan’s sincere offer, India has asked Pakistan to grant consular access to Jadhav in private and without any hassle and fear. On August 1, Pakistan had offered the access to India in the light of International Court of Justice (ICJ)’s ruling. India confirmed Pakistan’s offer and sent conditional reply.
